The 2024 Maryland Tobacco Modernization Act, effective October 1, 2024, brings significant changes that all tobacco retailers in Maryland must follow to avoid penalties. These updates aim to enhance public health and ensure a safe marketplace by tightening regulations around tobacco product sales.

Key Changes Under the 2024 Maryland Tobacco Modernization Act

The new Act enforces stricter controls on the display and sale of tobacco products:

  • Secure Product Display: Retailers must keep cigarettes, tobacco products, and electronic smoking devices behind a counter. This change minimizes the risk of unauthorized access, particularly by minors.
  • Mandatory ID Verification: Retailers must verify the customer’s age using a valid government-issued photo ID before selling any tobacco product. This step is crucial to prevent underage sales.
  • Increased Licensing Fees: The Act raises the county license application fee for selling tobacco products at retail, impacting new and renewing retailers.
